Standard Terms and Conditions

Services Provided
Contractor shall provide weekly / bi-weekly mowing, string trimming, and blowing off hard surfaces. Grass shall be mown to a height of approximately three (3) inches +/-.
- Debris & Clean-up: Contractor shall blow grass clippings off sidewalks, drives, and parking lots. Trash, branches, or other items requiring removal to mow can be completed for an additional cost.
- Chemical / Fertilizer Application: Only licensed applications will apply chemicals, complying with local regulations.
Schedule, Access & Weather
Services are typically scheduled based on the weather conditions and need for service.
- Client Responsibilities: Clients should ensure pets are indoors, any clean up from pets is completed, gates are unlocked, and no obstacles (toys, hoses, etc.) are left on the lawn.
- Weather Policy: Service may be delayed due to rain or extreme drought or weather conditions.
Payment Terms
Invoices sent (Month / Per Service) are due within 30 days. Late payments are subject to a fee or suspension of service.
Damages & Liability
Contractor is liable for damage caused by negligence (e.g., hitting fences). Contractor is not liable for damage to items left in the lawn or shallow irrigation lines.
Termination
This agreement may be terminated at any time by providing the other party with 7 days written notice. Upon termination, Central Michigan Mowing L.L.C. will immediately stop working. The client's sole liability will be to pay Central Michigan Mowing L.L.C. all undisputed amounts under this agreement and any outstanding statements of work for services performed as of the date of the notice of termination.
Disputes & Applicable Law
The parties agree that any disputes arising out of or relating to this agreement shall be submitted to arbitration conducted by the American Arbitration Association in accordance with their rules, and the parties shall equally defray the arbitrator's fees. The final arbitration decision shall be enforceable through the courts of the state of Michigan.
In the event that this arbitration provision is unenforceable by any court of competent jurisdiction, then this contract shall be as binding and enforceable as if this section were not a part of it. This agreement shall be construed in accordance with and governed by the laws of the state of Michigan.
General Provisions
- Entire Agreement: This agreement constitutes the entire agreement between parties hereto with respect to the subject matter and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral. Client acknowledges that it is entering into this agreement solely on the basis of the representations contained herein.
- Additional Work: Any additional work outside of the services detailed herein shall be detailed in a statement of work and signed by all parties.
- Notices: All notices, requests, consents, claims, demands, waivers, and other communications hereunder must be in writing and addressed to the parties at the addresses listed above on this agreement. All notices must be personally delivered or sent via certified or registered mail.
